PRIVACY POLICY

Caruso y Ana SL (hereinafter “MIOH” or “we”) undertakes to protect the privacy of all registered users or subscribers (hereinafter “you” or “the user”) of the website www.mioh.eu ( "Web page"). This Privacy Policy explains our practices regarding the use of personal data obtained and processed on our website.

By using our website and services (hereinafter “our Services”) and, more specifically, by providing us with your personal information when registering, making a purchase or contacting us for any reason, you explicitly accept this Privacy Policy and You give us your full consent for us to collect, store and process your personal data in accordance with the conditions set forth in this Policy, including the sending of electronic communications.

Please note that we may have to modify this Privacy Policy as necessary to adapt it to legislative or jurisprudential changes that take place in the future. We will notify you of such changes by posting a notice on our web pages and in this Privacy Policy.

Unless some local regulation establishes otherwise, the Privacy Policy is governed by the laws of Spain.

  1. DATA COLLECT

Navigation. We do not collect any type of personal data if you are only browsing the website, except in the case described in the "Technical data" section.

Web forms. If you send us any web form (Registration, Subscription, Contact), we collect the data indicated in the forms and provided by you, including your name and email address. Mandatory data is indicated. These data are used to process your request and contact you for future notifications.

Inscription. When creating an account as a MIOH Member, we collect the following personal data: first name, last name and email address.

Online shopping. When making a purchase at MIOH, we collect the following personal data: name, surname, postal address, billing address and email address. The purchase is made through the payment gateway integrated into www.mioh.eu operated by our partner STRIPE, which collects credit card details, owner details and security number. These data are collected and processed by said partner, subject to its own privacy policy and legal conditions. The data in question are mandatory and if they are not provided, the purchase cannot be made.

Prohibited data. In any case, including in the open spaces of our blogs and forums, it is prohibited to provide us with or publish in any of our Services data that contains sensitive information related to identifiable persons, such as: their racial origin or that of third parties; union membership; religion, ideology and sexual orientation; your health or that of third parties, unless it is necessary to prove any handicap or situation of disability for employment purposes; o Data related to criminal records, procedures and sanctions or fines derived from them, both yours and third parties.

Invite a friend. In the event that the option to "invite a friend to participate in the MIOH community" is enabled, you can insert your email in the corresponding form. The registered user declares and guarantees that he has the express consent of this third party for the transfer of his data to MIOH with the sole purpose of sending him the information that the registered user believes may be of interest to this third party, MIOH not being responsible for the sending said information to the third party in question. Said email address will be treated in accordance with this Privacy Policy. The registered user undertakes to hold MIOH harmless from any possible claim, fine, penalty or sanction that may be forced to bear as a result of the registered user's failure to request the consent of the third party to receive this type of information.

  1. DATA USE

General. The data we collect is used to maintain commercial contacts with the user, manage any newsletters, notification emails or commercial communications in general related to our Services and products and any new benefits, sales, offers or promotions that we offer, provide and manage your account and our Services and product sales (as described in the Terms and Conditions), as well as comply with the General Conditions and make other legal communications.

Divulgation. We treat your personal data confidentially in accordance with applicable legislation. However, we will disclose certain information as follows:

  • We share your identification data with STRIPE (our payment gateway partner) to make the corresponding payments with your credit card.
  • We disclose any information, whether or not of a personal nature, about you or your use of our Services in accordance with a legal obligation, in order to properly provide our Services, or to fulfill other obligations under applicable rules and regulations set forth in the Terms and Conditions of the website.

Transfer of data to Aplázame (in the event that the client contracts the deferred payment service with Aplázame). The user accepts that all their personal data will be fully transferred to Aplázame from the moment the user has started contracting the deferred payment service offered by the latter at the time of choosing the payment method.
This acceptance extends to third parties that had to access the files for the good end of the contract.

Use of data by other users. If you have access to personal data of other users or persons, you agree to treat and use said data in accordance with the provisions of these conditions and only for the explicit purposes of our Services, unless you have the express consent of the user. You will not provide or publish any personal data relating to any individual that has not been authorized by such person or this Privacy Policy. You will protect the confidentiality of any accessible personal data and prevent access by any unauthorized third party. You will inform us of any problem related to the management of user data within 24 hours after it occurs. You will be responsible for any illegal use you make of other users' data, including any use contrary to applicable data protection laws and/or that violates this Privacy Policy.

Commercial communications. By completing and sending us your information, you expressly agree to receive commercial communications related to MIOH in accordance with applicable legislation, including alerts, notifications, newsletters, offers and promotions. If you do not wish to receive information from this website, please let us know by sending a notification to info@mioh.eu.

  1. DATA SECURITY

We have adopted technical and organizational measures to preserve and protect your personal information from unauthorized use and access, as well as from its alteration, loss or improper use, taking into account the latest technological advances, the characteristics of the information stored and the risks to which is exposed.

However, due to the nature of the information and associated technology, we cannot ensure or guarantee the security of your personal information and we expressly disclaim any such obligation. If we become aware of a security breach, we will attempt to notify you by email so that you can take appropriate action.

  1. TECHNICAL DATA

Cookies. This website uses "cookies", small data files generated on your computer and associated with users. The cookies used cannot read data from the hard drive. Cookies also allow users to be recognized only when they have registered, so that they do not have to register again each time they visit or access areas or services reserved exclusively for them. They also offer information on the date and time of the user's last visit to the web page and the content selected in browsing. The cookies we use cannot read data from the User's computer or read the cookies that exist on your computer.

Information about your computer. Due to Internet communication standards, when you visit our website we automatically receive the URL of the site you came from and the site you visit when you leave our website. This information is not shared with third parties without your consent.

Google Analytics. This website uses Google Analytics, a web analytics service provided by Google, Inc., a Delaware company whose main office is at 1600 Amphitheater Parkway, Mountain View (California), CA 94043, United States (“Google”). Google Analytics uses "cookies", which are text files located on your computer, to help the website analyze how users use it. The information generated by the cookie about your use of the website (including your IP address) will be directly transmitted to and stored by Google on servers in the United States. Google will use this information on our behalf for the purpose of tracking your use of the website, compiling reports on website activity and providing other services related to website activity and Internet usage. Google may transmit said information to third parties when required by law, or when said third parties process the information on Google's behalf. Google will not associate your IP address with any other data held by Google. You can refuse the processing of data or information by rejecting the use of cookies by selecting the appropriate settings on your browser; however, you should be aware that if you do so you may not be able to use the full functionality of this website. By using this website, you consent to the processing of information about you by Google in the manner and for the purposes indicated above.

  1. RIGHTS OF THE USER

You have the right to access, rectify, delete, block and oppose any processing of your personal data. In addition, you can withdraw your consent to the processing of your data and personal information at any time. This resignation will not have retroactive effect, but it could prevent the provision of our Services. The foregoing is understood without prejudice to the provisions of the applicable Spanish legislation regarding the conservation of data for the purpose of defending our responsibility and complying with legally established obligations. The User can exercise their rights of access, rectification, cancellation and opposition provided for in the LOPD, by means of a written communication addressed to MIOH, c/ Portalada 50H, 26006 Logroño (La Rioja); or by email addressed to info@mioh.eu. In both cases, the interested User must accompany a copy of his national identity document, passport or other valid document that identifies him.

  1. USER CONSENT

By completing the forms on the website and providing your personal data, you declare that you have read and accepted the conditions of this Privacy Policy. Notwithstanding the generality of the foregoing, you expressly and unequivocally consent:

  • That we collect and process your personal data in accordance with the purposes indicated and this Privacy Policy.
  • The processing of your data outside the European Economic Area by third parties in charge of the treatment (eg, for the purpose of providing us with professional services such as hosting or database management services).
  • The receipt of commercial emails sent by us.
  • The communication of data to other users of the web outside the European Economic Area, at the request of the user or in the social spaces of the Website.
